These terms govern your use of DisasterAtlas (the "Service"), operated by Braden Charles ("we", "us"). By accessing or continuing to use the Service, you agree to these terms and that you are contracting with Braden Charles.

The Service

DisasterAtlas is an interactive historical map of U.S. disasters compiled from public data sources (NTSB, NOAA, USGS, NIFC, FRA and curated records). It is free to use with ads. An optional one-time Supporter purchase removes ads for your account.

Information on the Service is for general and educational purposes only. Data may be incomplete or inaccurate and must not be relied on for emergency, safety, legal, insurance or other professional decisions.

Eligibility and accounts

You must be of legal age in your jurisdiction (or have a guardian's consent) to make a purchase. If you sign in, you are responsible for keeping your account secure, for activity under it, and for providing accurate information.

Acceptable use

You must not misuse the Service, including by:

  • using it for any unlawful purpose, fraud or spam;
  • infringing intellectual property rights;
  • interfering with its security, introducing malware, probing for vulnerabilities, or scraping it at scale;
  • reverse engineering, reselling, redistributing, or circumventing technical limits of the Service.

Intellectual property and licence

We retain all rights to the Service, including its software, design, documentation and branding. Public source data remains subject to its original terms. We grant you a limited, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes.

Payments

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See our pricing and refund policy.

Service level and warranties

We do not guarantee that the Service will be uninterrupted, error-free, or that data will be complete or current. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Limitation of liability

To the extent permitted by law, we are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill), and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury where the law does not allow it.

Indemnity

You agree to indemnify us against claims arising from your unlawful use of the Service or breach of these terms.

Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. When access ends, account data is deleted as described in our privacy notice.

General

These terms are governed by the laws of the State of Texas, USA, and disputes will be resolved in the state or federal courts located in Texas, unless local consumer law provides otherwise. We are not responsible for delays caused by events beyond our reasonable control. You may not assign these terms without our consent; we may assign them in connection with a merger or acquisition. We may update these terms and will post changes here.
